This matter is taken up through virtual/physical mode. 2.

The Original Application No. 163 of 2016 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAPC) No. 163 of 2016.

The Petitioner having remained absent unauthorisedly, was handed over penalty as a result of disciplinary proceeding vide order dated 21st January, 2012. The Government of Odisha in Health and Family Welfare Department imposed the following penalties under Rule 15 of the Odisha Service (Classification, Contractual and Appeal) Rules, 1962:- "After careful consideration of the record of proceedings and his written statement of defence, Government have been pleased to impose the following penalties. i) Censure ii) Two increment stopped without cumulative effect.

iii) Period of suspension be treated as such."

Learned Tribunal has pointed out that the Petitioner has filed the petition beyond the period of limitation and the petition is barred by limitation.

None appears for the Petitioner at the time of call. It seems that no steps have been taken explaining the delay in approaching the Tribunal.

In such view of the matter, the writ petition stands dismissed.
