BLAPL No. 9694 of 2021 Lal Sing Munda@ Patanga & Another ....
Petitioners Mr. S.K. Pattnaik, Advocate - Versus - State of Odisha ....
Opposite Party Mr. P.K. Maharaj, Addl. Standing Counsel
CORAM:
JUSTICE SASHIKANTA MISHRA
ORDER
19.04.2022 1.
This matter is taken up through hybrid mode.
Order No.
2.
2.
Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.
3.
The petitioners are in custody since 04.12.2020 in connection with Koira P.S. Case No.140 of 2020 corresponding to G.R. Case No.770 of 2020 pending in the Court of learned S.D.J.M., Bonai for the alleged commission of offence under Sections 302/201/147/149 of IPC.
4.
The allegation is that the petitioners committed the murder of one Rama Munda and dumped his dead body in an abandoned well. As it appears from the case record, just prior to the recovery of the dead body of the deceased from the well, some villagers had seen the present petitioners and some other persons severely assaulting the deceased. It is also specifically stated that they had seen them dragging the petitioners towards the abandoned well. The witnesses have also ascribed a motive for the crime inasmuch as the deceased was said to have had an illicit relationship with the wife of one of the accused persons.
5.
Considering the above facts which prima face show the involvement of the petitioners in the occurrence, I am not incline to allow the prayer for bail, which is therefore, rejected. 6.
BLAPL is accordingly rejected.
