1. Heard learned counsel for the Petitioner and the State.
2. By means of this application under Section 438 Cr.P.C., the Petitioner seeks bail in anticipation of his arrest for alleged involvement in the offence under Sections 341/323/294/506/34 IPC.
3. Perusal of the record. It appears that counter case to have been filed by one Kanak Manjari Sahoo in connection with the self same issue.
4. Considering the facts and the other materials available on record, keeping in view the case and counter case and submission of the parties and having gone through the nature of allegations as emerged from the material on record and further the circumstances appearing, the seriousness and gravity of the offences, it is directed that in the event the Petitioner surrenders in connection with
// 2 // Deogarh P.S. Case No.738 of 2022 corresponding to C.T. Case No.1173 of 2022 pending in the court of learned S.D.J.M., Deogarh within a period of two weeks' hence and moves for bail, he shall be released on such terms and conditions as would be deemed just and proper by the said court with further conditions that he shall appear in person before the court below on each date of posting of the case unless specifically exempted by the court concerned.
