This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Spl. G.R. Case No.95 of 2022, pending in the Court of the learned Additional Sessions Judge -cum- Special Court, Padampur, arising out of Sohela P.S. Case No.195 of 2022, for alleged commission of offences under Sections 21(b)/25/29 of NDPS Act. 4.

Being aggrieved by the rejection of her application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Padampur, by order dated 26.10.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel that the contraband seized is to the tune of 159.600gms (Codeine Phosphate), which is admittedly less than the commercial quantity.

Taking note of the same and that the petitioner is a first offender as submitted, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
