This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.277 of 2022, pending in the Court of the learned J.M.F.C., Kantamal, arising out of Kantamal P.S. Case No.141 of 2022, for alleged commission of offences under Section 394 of IPC. 4.

Being aggrieved by the rejection of her application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Kantamal, by order dated 15.10.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the petitioner is in custody from 01.10.2022 and as investigation has substantially progressed, further continuance of the petitioner in custody is unwarranted, keeping in view that the robbery involves cash of Rs.6,050/-(Rupees six thousand fifty).

Learned counsel for the State opposes the prayer for bail inter alia that the petitioner has criminal antecedents, referring to the order of rejection.

Taking into account the nature of allegations against the petitioner, which is borne out from the 161 Cr.P.C. statement as annexed, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
