ORDER(Oral) 14.7.2022 01 1. This matter is taken up through hybrid mode.

2. The writ petition has been registered before this Court on 22.12.2021 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack.

3. On perusal of the available order sheets of the learned Tribunal it is indicated that on 7.1.2016 the matter was taken up and the learned Tribunal has observed as follows : "Vide order passed in O.A. No. 4034(C)/15."

4. Since the records in O.A. No. 4034(C)/15 are not available, this Court is not in a position to know what exact order is passed.

5. It is fairly submitted by learned counsel for the petitioner that the matter is an old one pertaining to grant of RACP from a particular date w.e.f. 1.1.2013 i.e. ten years of completion of service as an untrained teacher. It is further submitted that the learned counsel has no up-to-date instruction from the petitioner to pursue the matter at present.

6. The O.A. was filed by the applicant before the learned Tribunal seeking grant of revised assured career progression w.e.f. 1.1.2013.

7. It is fairly submitted by learned counsel for the petitioner that since the matter is old one, he has no up-to-date instruction from the petitioner.

8. It is further submitted that the writ petition may be permitted to be withdrawn to approach the authority for redressal of the grievance of the petitioner, if any.

9. As prayed for, the writ petition is disposed of with liberty as prayed for.

10. It is clarified that this Court has not expressed any opinion regarding merits of the contentions raised by the petitioner. (M.S.Sahoo) dutta Judge
