The Original Application No.2003 of 2014 (C) was filed before the Odisha Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No.2003 of 2014.

The petitioner considering himself to be academically sound in comparison to that of the Opposite Party No.3, challenged the selection and appointment of said opposite party as Grama Panchayat Extension Officer and Progress Assistant.

At the time of hearing today, Mr. S.P. Nath, Proxy Counsel on behalf of learned counsel for the petitioner submitted that he has no instructions in this matter. 4.

Mr.

Lalatendu Samantaray, learned Additional Government Advocate referring to paragraph 2 of the counter submitted that the petitioner's case does not deserve to be

The contents of said paragraph 2 of the counter is quoted herein below for better appreciation :- "That in reply to the averments in para 6.5 to 6.7, it is submitted that as per Notification No.2127/OSSC dated 03.08.2013 (at Annexure-5 of the O.A.) the last candidate selected in the SEBC(M) category is Prasanta Kumar Jena bearing roll No.07111904104. As per merit list of the candidates who appeared the viva-voice test (Annexure-4 of the O.A.) Prasanta Kumar Jena has secured 216 marks. The position of the applicant in the same merit list is at Sl. No.95 and he has secured 215 marks. As the applicant secured less mark than the last selected candidate in the category, he was not selected for appointment."

In view of the aforesaid position, the writ petition, sans merit, is dismissed.
