The primary grievance of the successful Order No.

purchaser-petitioner in the present writ petition is for a direction against non-pursuing of the application under Section 14 of the SARFAESI Act, 2002 filed by the Bank and pending before the Collector, Angul.

Mr. Samantaray upon instructions from the Collector concerned submits that the application under Section 14 of the SARFAESI Act, 2002 was filed by the Bank on 26.04.2022 and although as per the priority list, it falls low down for disposal. However, the Officer would make all endeavours to dispose of the said application before 28.02.2023.

In view of the above, learned counsel for the petitioner prays for permission to withdraw the writ petition.

The writ petition is accordingly dismissed as withdrawn.

The Officer concerned shall be bound by his stand before this Court.
