This matter is taken up through virtual/physical mode. 2.

The Original Application No. 1232(C) of 2014 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 1232 of 2014.

The Petitioner on the date of filing of this petition before the Odisha Administrative Tribunal was continuing as Headmaster, Level-IV Cadre. In the petition, the Petitioner had prayed for a direction to the Opposite Parties to re-cast the gradation list of Level-IV Teachers having B.Ed. qualification on the basis of date of passing of B.Ed. Examination and accordingly, the Opposite Parties were required to fix the seniority.

Mr. Bismayananda Prusty, learned Standing Counsel for School and Mass Education brought to the notice of this Court that at the time of filing of the petition, the Petitioner

// 2 // was declared that he was 57 years and by now, he would have retired.

By efflux of time, the matters seems to have been rendered infructuous.

Accordingly, the writ petition is disposed of as infructuous with liberty to the Petitioner to revive this petition within ninety days from today, if any cause of action still subsists.
