This matter is taken up through virtual/physical mode. 2.

The Original Application No. 185 of 2016 was filed before the State Administrative Tribunal, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OA) No. 185 of 2016.

The Petitioner by way of the writ petition has prayed for a direction to the Opposite Party Nos. 1 to 4 to grant him permission with effect from 1st December, 1988 as Head Master and fix up the scale of pay. It is submitted by the Petitioner that similarly situated persons were already promoted and arrear financial benefits with pensionary benefits have been extended to them.

Learned Tribunal while issuing notice vide order dated 2nd March, 2016 observed that pendency of the Original Application would not stand as a bar for consideration of grievance of the Petitioner.

Heard Mr. Nilambar Jena, Standing counsel for School and Mass Education.

Perusal of record shows that the Petitioner has made a representation dated 8th September, 2015 before the

// 2 // Commissioner-cum-Secretary to Government, School and Mass Education Department which is at Annexure-13. 5.

Keeping this matter pending any further would serve no fruitful purpose. Interest of justice would be best surved if the Opposite Party No.1 is directed to consider the representation as at Annexure-13.

The Opposite Party No.1 is directed to dispose of the representation, if pending before him, within a period of three months from today. Any decision taken thereto may be communicated to the Petitioner.

With the aforesaid observation, the writ petition stands disposed of.
