Heard Mr. Ashok Ku. Mohanty, learned counsel for the petitioner and Mr. Y.S.P. Babu, learned A.G.A 3.
The petitioner has filed the present writ petition challenging the order dated 26.8.2015 passed by Opp. party No.1 in rejecting his prayer for re-instatement and consequential sanction of pension and other pensionary benefits.

Mr. Mohanty, learned counsel for the petitioner submitted that similarly situated person namely one Bhagirathi Mohanty was also involved in similar activities and he was allowed to continue with imposition of minor punishment. Accordingly, Mr. Mohanty submitted that the petitioner being similarly situated, he is entitled to get similar benefit.

This Court after going through the impugned order finds that after his order of dismissal passed on 29.6.1979, the petitioner was allowed re-instatement with the
// 2 // undertaking that he will not involve himself in similar activities. As reflected in the said order, , the petitioner again indulged in similar activities and because of which he was disengaged from service w.e.f 1.5.1984.

In view of such conduct of the petitioner, this Court finds no illegality or irregularity in the impugned order. 7.
Accordingly, the Writ Petition is dismissed.
