Heard learned counsel appearing for the parties. 2.
Considering there is timely disposal of request of the petitioner at Annexure-3 also dependant on the outcome in a quasi judicial proceeding, involving Revision Petition No.790 of 2016, this Court in disposal of the writ petition directs the Tahasildar, Sadar, Cuttack for timely disposal of application at Annexure-3 at least within a period of two months from the date of communication of citified copy of this order by the petitioner. 3.
Looking to the difficulties in bringing such litigations even after a clear direction of the quasi judicial authority, this Court observes once the Revenue Authority has given specific direction in the matter of correction of record of right, unless there is stay of such order, there should not be pendency of such proceeding compelling the parties to bring further litigation to this Court. As this sort of litigations are unnecessary litigation and there is wasting of time for mere failure of proper exercise of power by the Tahasildar, the quasi judicial authorities should take case of this aspect.
