1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. This application for anticipatory bail U/s.438 Cr.P.C. has been filed by the Petitioners in apprehension of arrest for their alleged involvement in the offences U/s. 379/411/34, I.P.C. in connection with Bantala P.S. Case No.456 of 2022 corresponding to G.R. Case No.1643 of 2022 pending in the Court of learned S.D.J.M., Angul.
3. Learned counsel for the State submits that Case Diary has been obtained in the case and there is no criminal antecedent in respect of the present Petitioners under the same P.S.
4. Considering the submission of the parties and having gone through the nature of allegations as emerged from the materials on record, and further the circumstances appearing, the seriousness and
// 2 // gravity of the offences, it is directed that in the event the Petitioners surrender and move for bail before the learned S.D.J.M., Angul in the aforesaid G.R. Case, within a period of three weeks from today, they shall be admitted to bail on such terms and conditions as would be deemed just and proper by the said court, but subject to the condition that if criminal antecedents of similar nature is found against the petitioners by the Court below, then this bail order shall not be given effect to.
5. The ABLAPL is disposed of accordingly.
