Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.1086 of 2022, pending in the Court of the learned S.D.J.M., Keonjhar, arising out of Keonjhar Town P.S. Case No.228 of 2022, for commission of alleged offences under Sections 379/457/380/482/468/471/420/120-B/411 of IPC. 3.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Kenojhar, by order dated 20.10.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is seen that the petitioner is in custody since 18.07.2022 and as charge sheet has already been filed on 16.10.2022, petitioner seeks release.

Learned counsel for the State opposes the prayer for bail inter alia on the ground that criminal antecedent of the petitioner in
as much as it is stated that the petitioner is involved in 22 number of cases.

Taking into account the nature of allegations in the case at hand and period of custody and punishment prescribed notwithstanding the criminal proclivity of the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.

Keeping in view the criminal proclivity of the petitioner, this Court directs the petitioner to appear before the IIC Anandapur twice every week on such date and time to be fixed by the learned Court in seisin till conclusion of trial. Certification of such appearance shall be submitted to the Court in seisin and violation thereof shall entail cancelation.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
