The Petitioner prayed for a direction to the Opposite Party No.3 (Commandant, O.S.A.P. 6th Battalion, Khurda) to allow the Petitioner to join in the post of Sepoy/Constable in 6th Battalion, Khurda. The grievance of the Petitioner was that even though he was selected on being found suitable, on remeasurement of height, it fall short of the requisite height. 2.

At the time of hearing, Mr. Biswa Bihari Mohanty, counsel for the Petitioner submitted that the Petitioner is no more interested to pursue the matter and he does not want to press the petition.

In view of the such submission, the writ petition is dismissed as not pressed.
