This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for Petitioner and learned counsel for the State-Opposite Parties.

The present Writ Petition has been filed with the following prayer:- "(i) To allow this application.

(ii) To direct the Opp. Parties to allow him to subscribe to the General Provident Fund Odisha as well as to allot him a GPF number as per Section4 of the General Provident Fund (Orissa) Rules, 1938 as similar situated employees under the State Government have been benefited as per the letter No.38167/F/Pen17/13, dated 26.12.2013 (vide Annexure-5). (iii) To the periods of service render by the applicant from the date of his actual joining till regular appointment may be counted as qualifying service for the purpose of Pension as well as the provisions of OCS (Pension) Rules 1992 and GPF (O) Rules, 1938 may be allowed to be applicable to the applicant.

(iv) To consider and to dispose the representation of the applicant dated 3.6.2015 within the stipulated period.

// 2 // (v) To pass any other relief / beliefs to which the applicant is entitled to, which the Hon'ble Tribunal deems just and proper in the interest of justice".

He further submits that through highlighting his grievances, the petitioner has filed a representation on 03.06.2015 at Annexure-4 to the Writ Petition, before the opposite party No.2 but till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.2 to take a decision on the above noted petition within a specific time period. 5.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.2 to take a decision on the above noted petition in accordance with law and also taking into account the order passed under Annexure-4 within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.

6. With the aforesaid observation and direction, the Writ Petition is disposed of.
