Raghunath Mallik v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
WPC(OAC)No.135 of 2014 Raghunath Mallik ....
Petitioner Mr.S.S.Prusty, Advocate -versusState of Odisha & Ors.
....
Opp. Parties Mr.S.Mishra, ASC
CORAM:
MR. JUSTICE S.K. PANIGRAHI
ORDER
23.03.2022 Order No.
1.This matter is taken up by hybrid mode.
2.None appears for the petitioner at the time of call.
3. The petitioner has filed this writ petition challenging the order dated 27.07.2013 under Annexure-3 passed by the District Education Officer, Kendrapara/opposite party No.3.
4. Learned counsel for the State submits that since the case is of the year 2014, the transfer order might have been effected.
5. In view of such facts and submission, it seems that the cause of action might not be surviving any more. Accordingly, the writ petition is disposed of as infructuous.
6. However, liberty may be granted to the petitioner to approach this Court afresh, if any cause of action survives.
7. In view of the above, the WPC(OAC) is disposed of granting liberty as aforesaid.
