This matter is taken up through virtual/physical mode. 2.

The Original Application No.1246 (C) of 2014 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as W.P.C.(OAC) No.1246 of 2014.

By way of filing the Original Application before the State Administrative Tribunal way back in 2014, the Petitioner approached the Opposite Party No.3 for recruitment of Village Level Worker having obtained degree certificate and Diploma in Computer Application. Accordingly, he filed representation dated 02.09.2013 which the counsel for the Petitioner submits to be pending till date.

The State Administrative Tribunal issued notice to the Opposite Parties directing for filing of counter affidavit vide order dated 28th August, 2014.

Mr. Anupam Rath, learned Additional Standing Counsel submits that the matter having been transferred from

// 2 // the State Administrative Tribunal to this Court, the counter affidavit could not be filed and accordingly, sought for opportunity to file counter affidavit in the matter. 6.

Since the matter relates to 2014 and learned counsel for the Petitioner submits that the representation has not been considered as yet, it is felt deemed proper not to keep the matter pending.

The W.P.C.(OAC) is disposed of with liberty to the Petitioner to file a fresh representation along with the copy of original application along with all its annexures thereto before the Collector, Kalahandi and also certified copy of this order. 8.

On receipt of the said documents from the Petitioner, the Opposite Party No.3, namely, Collector, Kalahandi or any other competent authority shall take a decision as expeditiously as possible preferably within a period of four months from the date of production of certified copy of this order and other documents as referred to above in accordance with law. It is clarified that nothing is expressed on merits of the matters.
