This matter is taken up through hybrid mode.

When the matter was taken up on 18.04.2022, after hearing learned counsel for the petitioner as well as learned counsel for the State and considering the matter in some detail, the following order was passed:- "2. The writ petition has been renumbered and registered before this Court on 9.12.2021 after the O.A. was transferred, upon abolition of Odisha Administrative Tribunal, Cuttack Bench, Cuttack.

3. On perusal of the available order-sheet of the learned Tribunal, it is found that the matter was never taken up after 7.8.2014 and interim order was passed directing Annexures-4 to 7 to be kept in abeyance. Thereafter the matter was never taken/not pursued.

Original Application was filed in the year 2014 by the petitioner who was 55 years while working as Head Clerk in the office of the Executive Engineer, seeking a direction to quash Annexures-3 to 6 issued by the authority regarding recovery of excess amount that was to be deducted towards stepping up of pay granted to the petitioner working as Head Clerk in the office f the Executive Engineer, Chitrakonda.

4. Learned counsel for the petitioner submits

// 2 // that since the matter is old one, he has not been able to trace out the case brief and may be granted further time to do the needful. It is further submitted that he may be provided with copy of the counter filed by the State.

Accordingly, learned Standing Counsel shall do the needful.

5. As prayed for, list on 24.6.2022."

To grant opportunity to the learned counsel for the petitioner to trace out his case brief that was missing, the matter was again adjourned to 24.06.2022 and on the said date, none had appeared for the petitioner and to grant another opportunity to the petitioner, the matter was directed to be listed today.

Today none appears for the petitioner, when the matter is called.

Learned Standing Counsel reiterates the submissions on behalf of the State as noted in the order dated 18.04.2022.

Having heard learned Standing Counsel for the State, the writ petition is dismissed for non-prosecution. (M.S. Sahoo) Judge
