Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the State on instructions submits that notice has been served on the informant/victim on 27.11.2022. There is not appearance on behalf of the informant/victim when the matter is called.

The petitioner is accused in Spl. G.R. Case No.69 of 2021, pending on the file of the learned Ad Hoc Additional District and Sessions Judge, FTSC, POCSO Jagatsinghpur, arising out of Lock P.S. No.260 of 2021, for commission of alleged offences under Sections 376AB/376(2)(n)/506 of IPC and Section 6 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Ad Hoc Additional District and Sessions Judge, FTSC, POCSO Jagatsinghpur, by order dated

23.09.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner wants to withdraw this bail application with liberty to renew his prayer before the learned Court in seisin after examination of the victim. 6.
