This matter is taken up through hybrid mode.

When the matter was taken up on 31.3.2022, following order was passed :

"1. This matter is taken up through hybrid mode. 2.

The writ petition has been registered before this Court on 9th December, 2021 after the O.A. was transferred from the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition. 3.

On perusal of the available order sheets of the learned Tribunal, it is indicated that the matter was never taken up for admission after it was filed on 6.1.2014. The only date it was listed on 15.07.2014, none had appeared for the petitioner.

The O.A. was filed in the year 2014 when the applicant was 45 years of age, working as Assistant Teacher in Rangmundei Primary School, challenging the order dated 20.11.2013 (not enclosed to the O.A.) passed by the Deputy Director, School and Mass Education and the order dated 19.12.2013 (Annexure-5 to the writ petition) issued by the District Inspector of Schools, Salipur, opposite party no.3 by which the service of the persons pursuant to 1991 selection panel was terminated.

It is submitted by the learned counsel for the

// 2 // petitioner that since the matter is old one, he is not in touch with the petitioner and may be granted some time to obtain up-to-date instruction.

As prayed for, list on 10th May, 2022."

3. It is submitted by learned counsel for the petitioner that he has no up-to-date instruction from the petitioner for pursuing the litigation at present.

4. Learned Standing Counsel on behalf of O.Ps.-School & Mass Education Department reiterates the submissions on behalf of opposite parties as noted in the order dated 31.3.2022.

5. kHaving heard learned counsel for the parties, the writ petition is disposed of for lack of up-to-date instruction from the petitioner granting liberty to revive the same within sixty days for any surviving cause of action.
