This matter is taken up through video conferencing Order No.

mode.

The Petitioner being in custody in connection with Bamapada P.S. Case No.116 of 2021 corresponding to C.T. Case No.589 of 2021 arising out of ICC Case No.356 of 2021 on the file of learned S.D.J.M., Balasore running for commission of offence under section 420/34 of the IPC, has filed this application under section 439 of the Cr.P.C. for his release on bail.

Heard learned counsel for the Petitioner and learned counsel for the State as well as learned Counsel for the Informant.

Considering the submissions made and on going through the materials on record, while being not inclined to grant bail to the Petitioner, this application stands disposed of granting liberty to the Petitioner to renew his prayer before the

// 2 // Court in seisin of the case by citing all such developments which have taken place in the meantime including the factum of grant of bail to the co-accused and if similarly situated with the Petitioner on the ground of parity as per law, for their consideration in proper perspective and disposal in accordance with law without being influenced by the orders of this Court. It is needless to state that in the event any such move is made, the same shall be considered above and disposed of early in accordance with law.

The BLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned Counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020 as modified by Court's Notice No.4798 dated 15th April, 2021 and Court's Office order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
