Heard learned counsel for the Petitioner and learned counsel for the State.

3. The present Writ Petition has been filed by the petitioner challenging the rejection of his application for the post of Livestock Inspector pursuant to the advertisement issued by the CDVO, Keonjhar under Annexure-2/2.

4. It is submitted that in the said advertisement, the prescribed clarification for making such an application was I.Sc. or +2 Sc. or higher Secondary Science or equivalent examination. It is submitted that the petitioner possesses the qualification of +2 Science and in support of that, he has filed Annexure-2. The petitioner has passed +2 Science Examination conducted by the Higher Secondary Orissa in the year 2013. In view of the prescription made in the advertisement and the qualification possessed by the petitioner, this Court finds that the application of the petitioner has been illegally rejected on the ground that the petitioner has not possessed the qualification of +2

This Court finds that the learned Tribunal while issuing notice of the matter on 7.10.2016 had passed an interim order directing the petitioner to participate in the selection process. It is submitted that pursuant to the said order, the petitioner has been allowed to take part in the selection process.

Since this court finds that the petitioner possesses the requisite qualification, the rejection of his candidature is set aside. While setting aside the same, this Court directs Opp. party No.3 to intimate the petitioner as to whether he has qualified in the said recruitment test or not. If it is found that the petitioner has qualified in the said recruitment test, necessary follow up action be taken by the said opp. party within a period of three months from the date of receipt of this order.

With the aforesaid observation and direction, the Writ Petition is disposed of.
