This matter is taken up through virtual/physical mode. 2.

The Original Application No.1320 (C) of 2014 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 1320 of 2014.

None appears for the Petitioner at the time of call. 4.

The Petitioner claiming to be Night Watchman-cumSweeper, in the office of the District Statistical Office, Balasore prayed for a direction to the Opposite Parties to regularize his service. The Odisha Administrative Tribunal vide order dated 24th July, 2014 issued notice to the Opposite Parties directed for filing counter in the matter. 5.

Mr. Anupam Rath, learned Additional Standing Counsel stated that in obedience to said direction, the counter affidavit has been filed by the Opposite Party No.3 before the State Administrative Tribunal, Cuttack Bench, Cuttack. Mr. Rath with reference to the counter affidavit submits that the Petitioner was never officially recruited nor was ever given

// 2 // appointment letter to function as Night Watchman-cumSweeper in the office of District Planning & Monitoring Unit, Statistical Wing, Balasore.

Since the matter relates to 2014, by influx of time, the matter would have rendered infructuous by now. 7.

Accordingly, this WPC (OAC) is disposed of as infructuous with liberty to the Petitioner to revive this petition within ninety days from today, if any cause of action still subsists.
