2. Heard learned counsel for the parties.

3. The present Writ Petition has been filed with the following prayer:

"Let the Original application be admitted, notices may be issued to the respondents and after hearing the applicant this Hon'ble Tribunal be pleased to direct the respondents to observe/appoint the applicant as ECG Technician in Cardiology Department of SCB MCH, Cuttack against the vacant sanctioned post of ECG technician.

Let the respondents be restrained from appointing any fresh candidate against the said vacant post of ECG Technician.

Let this Hon'ble Tribunal be pleased to grant any other relief/reliefs as the applicant as entitled to."

Considering the nature of prayer made in the Writ Petition, the Petitioner is permitted to make a fresh representation before Opp. party No.3 within a period of three weeks days from today.

It is observed that if such a representation is filed by the Petitioner ventilating his grievances, the same shall be considered by Opp. party No.3 in accordance with law within a period of three months from the date of receipt of such representation. The order so passed by Opp. Party No.3 be communicated to the Petitioner also.

With the aforesaid observation and direction, the Writ Petition is disposed of.
