1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in apprehension of arrest for his alleged involvement in the offences U/s. 392 of IPC.

3. The learned counsel for the State submits that the present Petitioner is having three criminal antecedents to its credit in similar nature in respect to Raghunathpur P.S against G.R Case No. 172 of 2022, 174 of 2022 and 173 of 2022.

4. The learned counsel for the Petitioner also submits that the present Petitioner is a student of Sidha Baranga (Degree) College of Education & Technology, Punanga.

5. Keeping in view the submission of the parties, the nature of allegations as emerged from the materials on record, the

// 2 // circumstances appearing, the seriousness and gravity of the offences, while this Court is not inclined to grant the anticipatory bail, it is directed that in the event the Petitioner surrenders and moves for bail in connection with G.R Case No.174 of 2022 arising out of Raghunathpur P.S. Case No.180 of 2022 pending in the court of learned J.M.F.C., Raghunathpur within a period of three weeks' from today, he shall be allowed to go on bail on such terms and conditions as would be deemed just and proper by the said court subject to production of certificate duly issued by the Principal certifying continuation of his studies and recommending for a good conduct.

6. The learned Court below shall verify the authenticity of such certificate scrupulously.

7. In case the court found it suitable to grant bail beside others the further conditions be imposed as follows:

that the Petitioner shall appear in person before the learned court below on each date of posting of the case and shall appear before the I.O. / I.I.C. of the concerned P.S. once in a week on such date and time fixed by the I.O. / I.I.C. for a period of six months or till submission of Final Form as the case may be.

8. The ABLAPL is disposed of accordingly.
