The grievance of the Petitioner, Jr. Grade Typist, was that ignoring his case for promotion, the Opposite Party No. 3, Diaristcum-Despatcher, was promoted to the post of Auditor. 2.
At the time of call, none appeared for the Petitioner. 3.
Mr. L. Samantaray, learned Addl. Govt. Advocate has relied on para-2 of the counter affidavit which is as follows:- "That in reply to para 6(F) it is humbly submitted that the averments made by the applicant in this para is not correct. There is no common gradation list of Jr. Clerk & Jr. Gr.Typist. There are separate gradation list of Jr. Clerk and Jr. Gr.Typist secondly both the Jr. Clerk and Jr. Gr. Typist do not belong to one gradation list, as such Sri Swarup Kumar Sahoo and Deviprasad Mohanty cannot be considered junior to the applicant, as they belong to separate gradation list. Had they belong to one common gradation list Sri Swarup Kumar Sahoo and Sri Deviprasad Mohanty would have been junior to the applicant, since O.S.F.S.(LFA) Rules, 1995 does not provide for fixation of seniority among different cadre of ministerial officers of Local Fund Audit Organization." 4.
In view of such clear stand by the Opposite parties, this Court finds no merit in the matter.
