This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner as well as learned counsel for the State. Perused the record.

The present writ petition has been filed by the petitioner with the following prayers:

"The petitioner therefore most humbly prays that this Hon'ble Court be graciously pleased to allow this writ application and in the facts and circumstances narrated hereinabove be pleased to direct the Opposite Parties to re-engage the Petitioner or alternatively direct the Opposite Parties to consider the representation of the petitioner sympathetically taking into consideration that he was earlier engaged under WESCO as an outsourcing employee;

And pass such other order/orders as this Hon'ble Court deems fit and proper in the facts and circumstance of the case;"

It is submitted by learned counsel for the petitioner that earlier the petitioner was working under WESCO, now the WESCO has been taken by the Tata Power Western Odisha Distribution Ltd.

// 2 // (TPWODL) and the said TPWODL is not reinstating the petitioner although he is working under the WESCO previously. Accordingly, the petitioner had approached the authorities to take him back in service, however, the authorities have not taken any decision to reinstate the petitioner.

Considering the aforesaid submissions made and limited nature of grievance, this Court disposes of the writ petition at the stage of admission with a direction to the petitioner to file a fresh representation highlighting his grievances along with certified copy of this order before the Electrical Engineer, Tata Power Western Odisha Distribution Ltd.((TPWODL), Sonepur within a period of two weeks from today. In the event such a representation is filed within the aforesaid period, while considering the representation of the petitioner, shall take into consideration the petitioner was earlier engaged under the WESCO, the same shall be disposed by passing a speaking and reasoned order within a period of six weeks from the date of filing of fresh representation. Any decision taken on the same shall be communicated to the Petitioner within a period of two week thereafter.

With the aforesaid observation/direction, the writ petition is disposed of.

Urgent certified copy of this order be granted on proper application.
