This I.A. is filed for modification of the order dated 02.05.2022 passed in C.M.P. No.614 of 2021.

In course of submission Mr. Mohanty, learned counsel submitted that in the event the report U/o.26 Rule 9 of C.P.C. goes against the Petitioner, there should be scope to the Opposite Party to go for private report to have an effective adjudication of the suit. 3.
Mr. Bose, learned counsel on the other hand submitted that there is no prevention under law in bringing such report and there is no necessity for leave of this Court.

Considering the submissions of both the parties, this Court finds, when the law permits for bringing private report, in the event the reports obtained U/o.26 rule 9 of C.P.C. oppose to such party, there is no necessity for leave.

The I.A. thus stands disposed of.
