1. This matter is taken up through virtual mode.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 2nd August, 2021 in connection with Kodala P.S. Case No.370/2021 corresponding to G.R. Case No.380/2021 pending in the court of learned J.M.F.C., Kodala for the alleged commission of the offence under Sections 450/376/323/506 of I.P.C.

4. It is alleged that the Petitioner entered into the house of the victim while she was sleeping and took her to the terrace and

// 2 // forcibly committed rape on her. The victim has clearly described the occurrence in the statement recorded under Section 164 of Cr.P.C.

5. Considering the above facts, which reveals a strong prima facie case against the Petitioner, I am not inclined to allow the prayer for bail, which is, therefore, rejected.

6. It is open to the Petitioner to renew his prayer after examination of the victim during trial.
