1. Heard the learned counsel for the Petitioners and the State.

2. This application for anticipatory bail U/s.438 Cr.P.C. has been filed by the Petitioner in anticipation of arrest for his alleged involvement in the offences U/s. 341/323/325/307/294/506/34, I.P.C., in connection with Dhenkanal Sadar P.S. Case No.547 of 2022 corresponding to G.R. Case No.1427 of 2022 pending in the court of learned S.D.J.M., Dhenkanal.

3. Learned counsel for the Petitioners submits that co-accused persons namely Jagabandhu Dehury and Dibya Ranjan Sahu have since been released on bail by the trial court, vide order dated 14.11.2022 passed in BLAPL No.427 of 2022.

4. Considering the submission of the parties, having gone through the nature of allegations as emerged from the materials on record, the circumstances appearing, seriousness and gravity of the offence,

// 2 // it is directed that in the event the Petitioner surrenders and moves for bail before the learned S.D.J.M., Dhenkanal in the aforesaid G.R. Case within a period of three weeks hence, he shall be admitted to bail on such terms and conditions as would be deemed just and proper by the said court, but subject to the following further conditions - (i) The Petitioner shall appear before the I.O. once in a week till submission of charge-sheet;

(ii) He shall also appear before the trial court on each date of trial, without fail, till conclusion of the trial.

(iii) He shall not threaten, terrorise, ill-treat or harass the Informant and his family members including the prosecution witnesses in any manner whatsoever.

(iv) He shall not indulge in any other crime of similar nature in any manner whatsoever, while on bail.

Violation of any of the conditions shall entail cancellation of bail.

5. The ABLAPL is disposed of accordingly.
