1. Heard the learned counsel for the Petitioner and the State.

2. By means of this application, the Petitioners seek grant of bail U/s.438 Cr.P.C. in apprehension of arrest for their alleged involvement in the offences U/s. 363, I.P.C. in connection with Bhandaripokhari P.S. Case No.367 of 2022 corresponding to G.R. Case No.2803 of 2022 pending in the court of learned S.D.J.M., Bhadrak.

3. The F.I.R. as such reveals that only offence alleged against the Petitioner is under Section 363, I.P.C., which is bailable in nature.

4. Learned counsel for the State submits that the victim girl is yet to be rescued.

5. In such view of the matter, there is no point in keeping this application alive and accordingly the same is disposed of. ( Chittaranjan Dash ) Judge S.K. Parida
