This matter is taken up through virtual/physical mode. 2.
The Original Application No. 517 of 2016 was filed before the State Administrative Tribunal, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OA) No. 517 of 2016.

It is claimed by the Petitioner that though his head quarter was fixed in Bhubaneswar, he was deputed to work in the Government Ayurvedic Dispensionary (GAD) at Gudugudia, Mayurbhanj. Petitioner claimed that in view of Finance Department O.M No.55376-CS-IV-s/2008/F dated 26th December, 2008, he is entitled to get the house rent allowance meant for Bhubaneswar/Cuttack(urban area) in terms of revised rate.

Mr. P.K. Mohanty, Additional Standing Counsel raised serious objection to the contention of the Petitioner. He submitted that as the Petitioner was deputed to serve in the District of Mayurbhanj, the claim of the Petitioner on the basis of Finance Department Office Memorandum dated 26th December, 2008 has no basis.

It is seen from the record that the Inspector of Ayurveda Central Circle, Keonjhar has written letter to the Director of Indian Medicines and Homeopathy, Odisha,
// 2 // Bhubaneswar inviting instruction as to whether the present Petitioner would be entitled to house rent allowance @ 20% meant for Bhubaneswar.

It seems that the Opposite Party No.2, the Director, Ayush, has not yet acted upon the instruction sought for by the Inspector of Ayurveda.

The Opposite Party No.2 is, therefore, directed to take a decision in this regard as expeditiously as possible preferable within a period of two months from the date of production of certified copy of this order. A reasoned order shall be communicated to the Petitioner in this regard. 8.
With the aforesaid direction, the writ petition stands disposed of.
