The matter is taken up through video conferencing mode. 2.

Heard Mr. J. Sahoo, learned counsel for the Petitioner and Mr. G. Rout, learned Additional Standing Counsel. 3.

This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioner Ratan @ Srikanta Behera in connection with Barpali P.S. Case No.134 of 2018 corresponding to G.R. Case No.135 of 2018 pending in the court of learned J.M.F.C., Barpali for alleged commission of offence under Sections 341/348/294/302/506/34 of the Indian Penal Code.

It is submitted that the Petitioner is inside custody since 20th September, 2021 and as per allegations he dealt one blow by means of a batten.

Upon hearing Mr. Rout, learned Additional Standing Counsel and considering the statement of the eye-witnesses, the prayer for bail is rejected.

However, as prayed on behalf of t he Petitioner, he is at liberty to renew his prayer for bail after examination of the eye-witness in course of trial. The learned trial court is directed to take expeditious steps for early completion of trial.

The BLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, in the manner prescribed vide Court's Notice No.514 dated 7th January, 2022.
