This matter is taken up through virtual/physical mode. 2.

The Original Application No.251 (C) of 2015 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAPC) No.251 of 2015.

The Petitioner engaged as night watchman-cumsweeper was appointed on contingent basis with a consolidated pay, who has claimed to have joined in December, 1991 and subsequently disengaged on 30.01.2012. In this writ petition while challenging the order of disengagement dated 30.01.2012, the Petitioner prays for reinstatement with all consequential service benefits. 4.

Perusal of the records shows that on 18.07.2016, the matter was listed before the Odisha Administrative Tribunal on which date at the time of hearing, learned counsel for the Petitioner sought for an adjournment and thereafter, the matter has never been listed nor moved by learned counsel for the Petitioner.

Since the matter relates to 2015 and none appears for the Petitioner today, it is construed that the Petitioner is no more interested in pursuing the matter.

Mr. Anupam Rath, learned Additional Standing Counsel submits that the petition itself shows that the Petitioner was disengaged since 2012 as he was arrested and sent to jail custody on 26.01.2012 in G.R. Case No.2 of 20125 in the Court of Special Vigilance, Berhampur, the Petitioner is not entitled to be reinstated. 7.
