Gourang Charan Biswal v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
WPC (OA) No. 2883 of 2016 Gourang Charan Biswal .....
Petitioner Mr. R. Mohanty, Advocate Vs.
State of Odisha and others .....
Opposite Parties State Counsel
CORAM:
DR. JUSTICE B.R. SARANGI
ORDER
12.08.2022 Order No.
01.
This matter is taken up through hybrid mode.
2.
The petitioner has filed this writ petition seeking direction to the opposite parties to regularize his service along with all consequential service and financial benefits keeping in view his continuous service for more than 31 years within a stipulated time.
3.
Mr. R. Mohanty, learned counsel for the petitioner contended that in a similar matter, i.e., WPC (OA) No.2884 of 2016, the opposite parties have already filed counter affidavit on 05.05.2018, wherein it has been stated that government in Sports & Youth Services Department is not the sole decision taker, regarding absorption of "Temporary Status" employees into regular post. In this regard, after communication of Home Department letter no.37707 dated 14.08.2008 (copy enclosed at Annexure-E), a file has been moved to Finance Department for absorption of the applicant in regular establishment, which is under process. It is further contended that in the meantime, more than four years have been passed and he has no instructions as to whether the service of the petitioner has been regularized or not. Therefore, this writ petition may be disposed of in the light of the contention made in the counter affidavit filed in WPC (OA) No.2884 of 2016 on 05.05.2018. 4.
In view of the above submission, this Writ Petition stands
disposed of in the light of the contention made in the counter affidavit filed in WPC (OA) No.2884 of 2016 on 05.05.2018. If the service of the petitioner has not been regularized in the meantime, Government shall take steps for regularization of his service as expeditiously as possible, preferably within a period of three months from the date of communication/ production of certified copy of this order.
