(i) Why the impugned order dt.03.01.2014 and 04.01.2014 passed by Executive Engineer, Main Dam Division, Burla Respondent No.5 will be declared illegal and quashed.

(ii) Why the respondents will not be directed to regularize the service of applicant in regular post within stipulated period.

There is no dispute in Bar that the case involved herein but by different persons has already been allowed on allowing of O.A.No.1042(C) of 2014, (WPC (OAC) 1042, 1046, 1047, 1048, 1051, 1053, 1054,1141 and 2996 of 2014) disposed of along with WPC(OAC) Mo 1042 of 2014 on 09.05.2022 settling the position of law in favour of the petitioner and the direction herein above squarely applies to

the case of the petitioner.

Accordingly, this Court while finding the principle decided herein has direct application to the case of the petitioner at hand interferes in the impugned order dated 03.01.2014 and 04.01.2014 at Annexures-9 & 11 respectively directs the Public Authority i.e. opposite party no.1 to grant the benefits to the petitioner in the light of direction in the aforesaid disposed of cases by working out the same within one and half months from the date of communication of certified copy of this order along with certified copy of judgment dated 09.05.2022 in the above batch cases.
