Mr. Lenka, learned counsel for the Petitioner makes a statement for not pressing the application at hand on the premises that an appeal at the instance of the Petitioner involving order of conviction in the criminal proceeding is still pending. This Court finds, there is substance in the submission of Mr. Lenka, learned counsel for the Petitioner. In the process, liberty is, however, granted to the Petitioner to undertake appropriate proceeding depending on the ultimate outcome in the appeal proceeding involving the order of conviction in the vigilance case.
