This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

The Petitioner has filed the present Writ Petition with the following prayer:- (i) The Hon'ble Tribunal may be pleased to admit the original application.

(ii) The Hon'ble Tribunal may be pleased to quash paragraph 2(3) of the impugned finance Deptt. Resolution at Annexure-3 in so far as it denies the benefit of revised formula to the applicant and others who retired before 01.12.2008.

(iii) The Hon'ble Tribunal may be pleased to direct the respondent authorities to recompute pension of the applicant in accordance with the revised formula introduced vide the impugned Finance Deptt.

Resolution Dated 19.01.2009 at Annexure-3 and to pay her enhanced pension from 01.12.2008 without arrears up to 30.11.2008. within a stipulated time-frame.

(iv) The Hon'ble Tribunal may be pleased to issue any other order, or direction deemed fit to do justice in the matter".

Considering the submission made and without expressing any opinion on the merits of the case, the Petitioner is directed

// 2 // to make a fresh representation before the Opp. Party No.1 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three weeks hence.

It is observed that if such a representation is filed within the aforesaid period, the Opp. Party No.1 shall do well to take a lawful decision within a period of three months from the date of receipt of such representation. The order so passed by the Opp. Party No.1 be communicated to the petitioner. 6.

With the aforesaid observations and directions, the Writ Petition is disposed of.
