Heard learned counsel for the Parties.

The Writ Petition involves the following prayer:- "The petitioner humbly prays that this Hon'ble Court may be graciously pleased to issue Rule Nisi calling upon the Opp. Parties to show cause as to why letter dt.21.10.2021 (Annexure-9), so far as the rejection part is concerned, shall not be quashed and the insurance amount of Rs.30,000/- meant for late Basudeba Mallik shall not be paid to the petitioner immediately.

AND As to why the representation vide Annexure-10 shall not be disposed of by the Opp. Party No.5, being forwarded by the Opp. Party No.2, within a stipulated time.

AND For this act of your kindness the petitioner as in duty bound shall ever pray."

It is alleged on the asking of the Insurance Company to the Petitioner to come through the Nodal Agency, Petitioner has already made a request to the Nodal Agency- Opposite Party No.2 vide

// 2 // Annexure-10 since 19.01.2022. Petitioner has the allegation against the Nodal Agency not performing his responsibility by showing any decision thereon over a period of eight months. 4.

Keeping in view the Petitioner's claim to be forwarded by Opposite Party No.2 and the decision required to be taken by Opposite Party No.5, this Court while disposing of the Writ Petition observes in the event any such claim is pending before the Nodal Agency, it shall do well in taking a lawful decision in a way resolving the claim of the Petitioner involved herein and the entire exercise be completed by Opposite Party No.2 within a period of seven days from the date of communication of this order by the Petitioner. On receipt of complaint from the Nodal Agency or recommendation, if any, Opposite Party No.5 shall do well as in taking a lawful decision on the same at least within a period of two months thereafter. 5.

The Writ Petition stands disposed of.
