This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for the Petitioners and learned counsel for the Opposite Parties.

The Petitioners have filed the present Writ Petition with the following prayer:- (i) To direct re-structuring of the cadre and consequential up-gradation of the cadre of Assistant Public Prosecutors to the ranks of Junior Class-I in Group-A service as has been extended to other similarly cadre employees.

(ii) To extend consequential service benefits to the cadre employees recruited under Orissa Prosecution Service Rules, 1997.

(iii) To quash the order of rejection of the representation vide Annexure-5, and To pass such other order /s as this Hon'ble Tribunal deemed fit and proper having regard to the facts and circumstances of the present case.

And for which act of kindness the application shall as in duty bound ever pray". 4.

Considering the submission made and without expressing any opinion on the merits of the case, the Petitioners are directed to make a fresh representation before the

// 2 // Opp. Party No.1 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three weeks hence.

It is observed that if such a representation is filed within the aforesaid period, the Opp. Party No.1 shall do well to take a lawful decision within a period of three months from the date of receipt of such representation. The order so passed by the Opp. Party No.1 be communicated to the petitioner. 6.

With the aforesaid observations and directions, the Writ Petition is disposed of.
