Heard Mr. P.K. Mahapatra, learned Counsel for the Petitioner and Mr. A.K. Mishra, learned Additional Government Advocate appearing for the State Opposite Parties.

Mr. P.K. Mahapatra, learned Counsel for the Petitioner contended that though the proceeding was initiated against the Petitioner in 2005, but the same has not been concluded. In the meantime, the petitioner has retired from service and, as such, he has not been paid his retirement benefit in the name of pendency of the Writ Petition.

Mr. A.K. Mishra, learned Additional Government Advocate appearing for the State Opposite Parties contended that the Government will decide with regard to conclusion of the proceeding initiated against the Petitioner, as the Director
of Agriculture and Food Production has communicated to the Government for taking necessary steps, which is still pending.

In view of such position, this Court disposes of the Writ Petition with a direction to Opposite Party No.1 to take a decision on the pendency of the proceeding, pursuant to Annexure-4 dated 02.08.2005 as expeditiously as possible preferably within a period of four months from the date of production/communication of this Order.

Issue urgent certified copy as per rules.
