Order dated 30th June, 2022 (Annexure-12) passed in FAO No. 102 of 2016 is under challenge in this CMP, whereby learned Additional District Judge, Bhubaneswar dismissing the appeal confirmed the order dated 20th July, 2016 passed by learned 1st Additional Senior Civil Judge, Bhubaneswar in I.A. No.1040 of 2011 (arising out of C.S. No.1802 of 2011) dismissing an application under Order XXXIX Rules 1 and 2 C.P.C. filed by the Petitioner.

In course of hearing, Mr. Mohanty, learned counsel for the Petitioner prays for withdrawal of CMP to enable him to move the appropriate application before learned trial Court. 4.

This Court without expressing any opinion on the merits of the submission made by learned counsel for the Petitioner disposes of the CMP as withdrawn.
