Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

The Petitioner has filed the present Writ Petition with the following prayer:- (i) Under the above circumstances, it is therefore, humbly prayed that this Hon'ble Tribunal be graciously pleased to direct the opposite parties 1 and 2 to incorporate the name of the petitioner in the cadre of Junior S.E.S. as being maintained by the opposite party no.2, that being a State cadre and to place the petitioner suitably in such gradation list taking into consideration the date of entry of the petitioner to Government service as 7.6.1994 and to release the arrear dues of the petitioner as per the order of the Hon'ble High Court, which has also been approved by the Finance Department vide Annexure-7 to the Original Application, i.e.

the scale of pay and salary from 7.6.1994 to 14.4.1998 without any further delay.

(ii) Hon'ble Tribunal be further pleased to direct the opposite parties to consider the case of the petitioner for promotion taking into his seniority as per the gradation list prepared by the opposite parties 1 and 2 without any further delay".

Considering the submission made and without expressing

// 2 // any opinion on the merits of the case, the Petitioner is directed to make a fresh representation before the Opp. Party No.1 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three weeks hence. 5.

It is observed that if such a representation is filed within the aforesaid period, the Opp. Party No.1 shall do well to take a lawful decision within a period of three months from the date of receipt of such representation. The order so passed by the Opp. Party No.1 be communicated to the petitioner. 6.

With the aforesaid observation and direction, the Writ Petition is disposed of.
