Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. 2.

The petitioner is an accused in G.R. Case No.433 of 2020, pending in the file of learned J.M.F.C., Pipili, arising out of Delanga P.S. Case No.157 of 2020, for commission of alleged offences under Sections 341/294/324/307/34 of IPC and is in custody since 27.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Puri by order dated 22.10.2022 in the aforementioned case, the present BLAPL has been filed.

An affidavit has been filed on behalf of the informant/victim indicating, inter alia, that the petitioner is innocent and he has stated his name inadvertently.

Considering such submission, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned in seisin over the matter.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
