Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 05.10.2021 in connection with Khandapada P.S. Case No.196 of 2021 corresponding to G.R. Case No.191 of 2021, pending in the Court of learned J.M.F.C., Khandapada for the alleged commission of offence under Sections 419/420/468/471/34 of IPC read with Section 16 of Orissa Clinical Establishment (Control and Regulation) Act.

Having regard to the submissions made, the materials on record, the period of detention already undergone and the fact that charge sheet has already been submitted in the case, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose

including the condition that :

(i) he shall not run the clinical establishment in question or be involved with it in any manner whatsoever. (ii) he shall personally appear before the trial Court on each date of posting of the case, failing which appropriate orders shall be passed by the Court below to take him to custody again.

BLAPL is accordingly disposed of.
