This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

The Petitioner has filed the present Writ Petition with the following prayer:- "(i) Necessary direction be made to the respondents to count the past services of the applicant for the period from 9.7.1984 to 4.8.1996 as qualifying service for the purpose of pension and other post retrial benefits.

(ii) Any other order / orders or direction /directions be issued so as to give complete relief to the applicant".

Since prior to approaching this Court the petitioner at no point of time has approached the authority seeking extension of the said benefit, the petitioner is permitted to withdraw the writ petition with liberty to approach the Opposite Party No.3. It is observed that if any such application is filed within a period of two weeks from today, the said opposite party shall take a lawful decision on the same within a period of three months from the date of

// 2 // receipt of such representation. Since it is submitted that the claim of the petitioner is covered by a decision of this Court reported in 2006 (suppl. II), OLR-912, the Opposite Party No.3 while taking a decision on the claim of the petitioner shall also take into consideration that aspect. 5.

Accordingly, the Writ Petition is disposed of. (Biraja Prasanna Satapathy) Judge Subrat
