This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

Learned counsel for the Petitioner seeks liberty to amend the present writ petition and to challenge the order passed by the Appellate Authority dated 16.07.2012 during the pendency of the O.A.

However, this Court is not inclined to grant liberty to amend the present writ petition, which is pending since long. Moreover, the disposal of appeal gives rise to a fresh cause of action. 5.

In such view of the matter, the Petitioner is permitted to withdraw the writ petition with liberty to file a fresh writ petition challenging the order passed by the Appellate Authority dated 16.07.2012 within a period of four weeks from today. 6.

With the aforesaid observation the writ petition is disposed of as withdrawn with liberty as aforesaid.
