This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in T.R. No.335 of 2020, on the files of learned Additional Sessions Judge, Bhubaneswar, arising out of Laxmisagar P.S. Case No.191 of 2020, under Sections 376(2)(i) of IPC read with Section 4 of the POCSO Act and is in custody since 29.10.2020.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhubaneswar, by order dated 27.11.2020 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations and the period of custody, this Court directs the petitioner to be released on bail, on such terms to be fixed by the learned Court in seisin over the matter so as to ensure his presence on each date of trial. 6.
Accordingly, the BLAPL stands disposed of.
