Heard Ms. Dei, learned counsel for the Petitioner and Mr. Panigrahi, learned Addl. Standing counsel for the State-Opposite Parties.

The present Writ Petition has been filed challenging the order dated 10.06.2016 passed by the Opposite Party No.1 under Annexure-4.

Vide the said order, the entire pensionary benefit of the petitioner was kept withheld along with other penalties in view of the order of conviction and sentence passed against the petitioner in Bhubaneswar Vigilance P.S. Case No.37 dated 10.09.1997.

Mr. Panigrahi, further submitted that challenging the said order of conviction and sentence, the Petitioner has already approached this Court in Criminal Appeal No.567 of 2015. 6.
It is also submitted that while admitting the matter the order of conviction and sentence has not been stayed by this Court.

In that view of the matter, this Court finds no illegality or irregularity in the office order dated 10.06.2016 and accordingly while not inclined to entertain the Writ Petition. It is observed that such order shall be subject to final outcome of Criminal Appeal No.567 of 2015.
